Public offer

This document is a public offer (proposal) of the online store “Gem Industry” for the sale of goods.

General provisions

1. This public offer (hereinafter referred to as the Offer) is an official offer from the online store “Gem Industry” to any individual to enter into a retail purchase and sale agreement for goods on the Site remotely with the online store “Gem Industry” on the terms specified in this Agreement and contains all essential terms of the Offer.
2. The Buyer’s order of goods posted on the Site means that the Buyer agrees with all the terms of this Offer, the Privacy Policy and the User Agreement.
3. IT has the right to make changes to the Offer without notifying the Buyer.
4. The validity period of the Offer is unlimited, unless otherwise indicated on the Site.
5. The Site provides the Buyer with complete and reliable information about the product/services, including information about the main consumer properties of the product on the Site in the description of each product.

Subject of the Offer

1. The Site undertakes to transfer the goods to the Buyer on the basis of placed Orders, and the Buyer undertakes to accept and pay for the Goods under the terms of this Offer.
2. The name, price, quantity of goods, as well as other necessary conditions of the Offer are determined on the basis of the information provided by the Buyer when placing an order.
3. The ownership of the ordered goods passes to the Buyer from the moment of actual transfer of the goods to the Buyer and payment by the latter of the full cost of the goods. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are actually transferred to the Buyer.

Cost of goods

1. Prices for goods are determined by the Seller unilaterally and indisputably and are indicated on the pages of the online store located at the Internet address: https://gemindustry.org/
2. The price of the goods is indicated in rubles of the Russian Federation.
3. The final price of the product is determined by the sequential effect of discounts on the price of the product in the following order:
   • Promotional discount
   • Discount for regular customers
4. Payments between the Site and the Buyer for goods are made using the methods indicated on the Site in the section – Payment and Delivery

Moment of conclusion of the Offer

1. Acceptance of this Offer (agreement) is the Buyer’s placing an order for goods in accordance with the terms of this Offer. The Buyer places an order for the goods by performing the actions specified in the Payment and Delivery section, paragraph – How to place an order.
2. By accepting this Offer, the Buyer agrees that:

• registration data (including personal data) was provided by him voluntarily;
• registration data (including personal data) is transmitted electronically via Internet communication channels;
• registration data (including personal data) is transferred to the Site for the purposes specified in this Offer, the Privacy Policy, the User Agreement and can be transferred to third parties for the purposes specified in this Offer;
• registration data (including personal data) can be used by the Site to promote goods and services by making direct contacts with the Buyer using communication channels;
• for the purpose of additional protection against fraudulent activities, the registration data specified by the Buyer (including personal data) may be transferred to the bank that carries out transactions for payment of placed orders;
• The consent given by the Buyer to the processing of his registration data (including personal data) is unlimited and can be revoked by the Buyer or his legal representative by submitting a written application submitted to the Site.

Return of goods and funds

1. Return of goods is carried out in accordance with the Law of the Russian Federation “On the Protection of Consumer Rights”.
2. Refunds are made by returning the cost of the paid goods in cash or using bank details.
3. The product ordered in the “Custom Stone” section of the Site has individually defined properties. Returns and/or exchanges of these products of proper quality are not made (Article 21.6 of the Law of the Russian Federation “On the Protection of Consumer Rights”).

Delivery of goods

1. Delivery of the goods to the Buyer is carried out within the time limits agreed upon by the Parties upon confirmation of the order by an employee of the Site.
2. When delivering goods by courier, the Buyer puts his signature on the accompanying document or form. This signature confirms that the Buyer has no complaints about the packaging of the goods, the quantity and appearance of the goods. 
3. After receiving the goods, claims regarding the quantity, completeness and type of goods will not be accepted.

Validity period of the Offer

This Offer comes into force from the moment of its acceptance by the Buyer, and is valid until the acceptance of the public Offer is withdrawn.

Additional terms

1. The Site has the right to assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer to third parties.
2. The site and the services provided may be temporarily partially or completely unavailable due to maintenance or other work or for any other technical reasons. The Site’s technical service has the right to periodically carry out necessary preventive or other work with or without prior notification to Buyers.
3. The provisions of Russian legislation apply to the relationship between the Buyer and the Site.
4. If any questions or complaints arise from the Buyer, he must contact the Site by telephone or other accessible means. The parties will try to resolve all disputes that arise through negotiations; if no agreement is reached, the dispute will be referred to a judicial authority in accordance with the current legislation of the Russian Federation.
5. Recognition by a court of the invalidity of any provision of this Agreement does not entail the invalidity of the remaining provisions.
